1. Acceptance of Terms
By downloading, installing, or using Califax VPN ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
Califax VPN provides virtual private network services that encrypt your internet traffic and route it through our secure servers. The Service includes:
- Encrypted VPN tunnel connections
- Multiple server regions worldwide
- Location privacy features (GPS fuzzing, network location masking)
- Intelligent protocol selection
- Privacy dashboard with verifiable trust features
3. Eligibility
You must be at least 13 years of age to use the Service. If you are under 18, you must have permission from a parent or legal guardian.
4. Account Registration
- You must provide accurate information during registration
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized use of your account
- One account per person. Account sharing is not permitted.
5. Acceptable Use
You agree NOT to use the Service for:
- Any illegal activity under applicable law
- Distribution of malware, viruses, or harmful code
- Unauthorized access to computer systems or networks
- Harassment, abuse, or threats against others
- Distribution of child exploitation material
- Copyright infringement or intellectual property theft
- Spam, phishing, or social engineering attacks
- Interfering with or disrupting the Service or its infrastructure
We reserve the right to terminate accounts engaged in prohibited activities.
6. Subscription and Payment
- The Service offers free trial and paid subscription plans
- Payments are processed securely by Stripe
- Subscriptions auto-renew unless cancelled before the renewal date
- Refund requests must be submitted within 30 days of purchase
- Prices may change with 30 days advance notice
7. Free Trial
- New users receive a 14-day free trial with full feature access
- Only one free trial per user/device
- No payment information required for the trial
- The trial converts to a paid subscription only if you choose to upgrade
8. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for:
- Temporary service interruptions due to maintenance
- Issues caused by your internet service provider
- Government-imposed network restrictions or censorship
- Force majeure events
9. Intellectual Property
All aspects of the Service, including but not limited to software, design, graphics, logos, and documentation, are the intellectual property of GuardLinkX Inc. and are protected by copyright, patent, and trademark laws.
You may not copy, modify, distribute, reverse-engineer, or create derivative works from any part of the Service.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The Service is provided "AS IS" without warranties of any kind
- We are not liable for any indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim
- We are not responsible for the actions of third-party websites or services accessed through the VPN
12. Indemnification
You agree to indemnify and hold harmless GuardLinkX Inc. from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
13. Termination
- You may terminate your account at any time through the app settings or by contacting support
- We may terminate or suspend your account for violation of these Terms
- Upon termination, your right to use the Service ceases immediately
- Account data will be deleted within 30 days of termination
14. Governing Law
These Terms shall be governed by the laws of the State of New York, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of New York County, New York.
15. Changes to Terms
We may update these Terms periodically. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
